If Foto Erhardt GmbH ships the goods to the customer, the risk shall transfer to the customer on handover of the goods to the shipping company for business deliveries or on handover of the goods by the shipping company to the consumer.
6.2 The warranty begins on the delivery of the goods and is determined by legal provisions. Should repairs or modifications be carried out on the delivered item by the customer or by third parties, without the written consent of Foto Erhardt GmbH, all warranties shall become void. Sentence two shall not apply, if the customer provides evidence that the defect in question was not caused by the modifications carried out by him or the third party.

Otherwise all returns are free of charge to our customers.

8.2 Notice on the right of cancellation
Consumers (Section 13 German Civil Code (BGB)) are entitled to the following right of cancellation:

Your right of cancellation

You may cancel your contract in writing within 14 days (for example by letter, fax, email) without stating a reason or - if you take possession of the items prior to the expiry of this deadline - by returning the items. The deadline begins upon receipt of this notice in written form, however not before the receipt of the goods by the customer (for the repeated delivery of goods of a similar nature, not prior to the receipt of the first partial delivery) and also not prior to the fulfilment of our information obligations in accordance with Article 246, Section 2 in conjunction with Section 1, paragraphs 1 and 2 of the Introductory Act to the German Civil Code (EGBGB), as well as our obligations arising from Section 312 g, paragraph 1, sentence 1 BGB in conjunction with Article 246 Section 3 EGBGB. The date of sending of the notice of cancellation or of the items shall determine observance of the cancellation period. Notice of cancellation is to be sent to:

Foto Erhardt GmbH
Gartenkamp 101

Consequences of cancellation

If cancellation becomes effective, the performance received by both parties shall be returned and, if applicable, any derived profits (for example interest) shall be surrendered. Should you not be able to return the performance or benefits received (for example advantages of use), either in full or in part, or only in a deteriorated condition, you shall be required to provide us with compensation. You shall only be required to provide compensation for the deterioration of the items and for benefits derived therefrom if the benefits or the deterioration result from the handling of the items, which exceeds the examination of the item‘s properties and function. The "examination of properties and function" is understood to consist of testing and trying out the respective goods, as is possible and customary in a normal store. Items that can be shipped by parcel shall be returned at our risk. You shall bear the normal cost of the return, if the delivered goods match the ordered goods and if the price for the returned items does not exceed 40 euros or, if the price is higher, the customer has not yet paid the consideration due or has only paid the instalment agreed in the contract at the time of cancellation. Otherwise all returns are free of charge to our customers.. Items which cannot be sent as parcels will be collected by us. Obligations for the reimbursement of payments shall be fulfilled within 30 days. For you the deadline begins on the date of sending your notice of cancellation or the items, and for us on the date of receipt.

End of the notice on the right of cancellation

8.3 Additional information: Unless otherwise agreed, the right of cancellation does not apply to distance selling contracts for the delivery of goods which were made according to customer specifications (for example photographic work), or which are clearly done to meet the customer’s personal needs (for example custom mounts and picture frames).
In accordance with Section 312, paragraph 4, No. 2 BGB, the right of cancellation or return for distance selling contracts shall exclude audio or video recordings and software, as well as delivered data media, insofar as the customer removes the seal. Software which is delivered with hardware may only be unsealed, if the software is absolutely necessary for the examination of the hardware.
